The United States Needs a New, Separate Constitutional Court



THE JEFFERSON ARGUMENT AND THE GERMAN SOLUTION


Okay let’s talk about something that has been sitting in the founding documents this whole time and we need to review for sustenance and strength. 


If the fall of the Twin Towers broke something in you, brace yourself , the collapse of America will break the rest. 


Thomas Jefferson was not a perfect man. He owned enslaved people and that is part of his record, full stop. but he was clear eyed enough to know that the government he was building could one day become the very thing it was created to prevent. So he wrote an exit clause directly into the declaration of independence. that document. the one certain people love to wave around when it’s convenient.


Here is what it actually says.


“We hold these truths to be self-evident, that all men are created equal, that they are endowed by their Creator with certain unalienable Rights, that among these are Life, Liberty and the pursuit of Happiness. That to secure these rights, Governments are instituted among Men, deriving their just powers from the consent of the governed.”


Read that last part again. governments derive their power from the consent of the governed. not the other way around.


And then Jefferson went further. he wrote what happens when that relationship breaks down.


“That whenever any Form of Government becomes destructive of these ends, it is the Right of the People to alter or to abolish it, and to institute new Government, laying its foundation on such principles and organizing its powers in such form, as to them shall seem most likely to affect their Safety and Happiness.”


NOT a suggestion. A right. And then he named the threshold for when that right becomes a duty.


“But when a long train of abuses and usurpations, pursuing invariably the same Object evinces a design to reduce them under absolute Despotism, it is their right, it is their duty, to throw off such Government, and to provide new Guards for their future security.”


A long train of abuses designed to reduce the people to despotism. That is Jefferson’s exact language for the moment we are in. and he also knew people are slow to act. he wrote that too.


“all experience hath shewn, that mankind are more disposed to suffer, while evils are sufferable, than to right themselves by abolishing the forms to which they are accustomed.”


We have been suffering what is sufferable for a long time. a congress that had every legal tool available to check executive overreach watched it happen in real time and chose to fall in line. the votes are public record. the silences are documented. $5.5 billion dollars a year in taxpayer money funded people whose one job was to protect the constitution and they chose not to. that is not confusion. that is a choice. and Jefferson’s own words describe exactly what that kind of sustained betrayal justifies in response.


Now let’s talk about a country that actually learned from its mistakes.


After world war two Germany looked hard at how fascism took over from the inside. one of the central answers was this . there was nothing strong enough to stop a government from dismantling democracy from within. the courts failed. the legislature failed. the institutions that existed to protect the people either stepped aside or actively participated. so when Germany wrote its new constitution, called the Grundgesetz (GROON-duh-geh-sets), meaning the Basic Law, they built something specifically designed to make sure it could never happen again.


They call it the Bundesverfassungsgericht. say it slowly boon-des-fair-FASS-oongs-guh-richt. it means Federal Constitutional Court and its official title is Guardian of the Basic Law. it has been doing that job since 1951 and here is why it is genuinely different from anything America has.


First it exists for one purpose only. protecting the constitution. THAT is the entire job. it does not hear regular court cases. it does not get pulled into ordinary legal disputes. Its sole function is to make sure every branch of government stays within the boundaries of the constitution. AND ITS decisions cannot be appealed. by anyone. EVER. 


Second, and this is the part that should make every American stop and think, any ordinary citizen can directly file a complaint with this court if they believe their fundamental rights have been violated by any government action. For a law they think is unconstitutional. Over a government policy that harms them. For a court ruling that violated their rights. any of it. You do not need to be wealthy to access it. Everyone in America without $$ or connections gets screwed in the American Justice system. A system now filled to the rafters with crooks and lawyers (who deserve a category of vileness alone) in Germany you do not need to spend years working a case through expensive courts hoping it might eventually reach the top. The door is open to the people it exists to protect. THAT is what accountability built into a system actually looks like.


3rd, and this is the genius part! the structure is specifically designed to prevent the court from being politically captured. justices are elected by a two thirds majority of both houses of parliament. That means both sides have to agree, which forces real consensus rather than partisan appointments. judges serve one single term of twelve years with mandatory retirement at 68 and they cannot be re-elected. ever. which means they have zero incentive to keep pleasing whoever appointed them. they are not auditioning for a second term. They are not building a legacy that depends on political loyalty. they do the job and then they are done.


Compare that to America’s supreme court. Scrotum U.S. justices are nominated by the president, confirmed by a simple senate majority, and serve for life. Which means a president can place ideological allies on the court who will be making decisions for 30 or 40 years. that is not a a small hitch or hurdle that crept in. that is was and continues to be a design vulnerability that was deliberately exploited over decades. and now we are living with the consequences.


What America needs is its own Bundesverfassungsgericht. In case you don’t know what that is, it’s an independent body with one job …to protect the constitution. There are term limits that free justices from political loyalty. Theres a citizen complaint mechanism that doesn’t require a fortune to access. And decisions that cannot be overturned by whoever happens to be in power.


And alongside that we need to actually teach people what the constitution means and what it protects. Not a myth. Not a brand. the real thing. because a democracy where people don’t understand what they’re supposed to be protecting is a democracy that can be taken from them slowly and they won’t see it coming until it’s already gone.


Germany did this reckoning 75 years ago. they looked at the worst chapter of their history ( WW2) and they built structures to make sure it could never happen again. They did the hard work. 


America has not done that work. and we are watching in real time what happens when you don’t.


Jefferson left us the framework. Germany showed us what the solution looks like. The question is whether we have the will to demand it.


The receipts exist. The names are on record. Accountability does not have an expiration date.
